These Terms and Conditions govern the relationship between you (“the Client”) and Nati Davis – Musikproduktionen, Designs, located in Germany and operating under the VAT-ID: 97 308 861 258. By placing an order via this website or directly via email/communication, you accept these Terms and Conditions. If you do not agree with them in full, you must cease using the website and services immediately.
1. General
Upon receipt of your order, we will send an automatic confirmation email acknowledging receipt. This acknowledgment does not constitute acceptance of your order. A contract is only formed once we send you a separate order confirmation including a delivery timeframe and payment instructions.
Please review the confirmation carefully. Any errors must be reported immediately. You may correct errors in your order until final submission.
Unless otherwise stated by local consumer protection law, all purchases are final, non-refundable, and non-transferable, except as described under Section 7 (Returns and Refunds).
We make every effort to ensure our product descriptions, prices, and images are accurate. However, small deviations, especially in color or finish (e.g. due to screen displays), are possible and do not constitute grounds for cancellation.
Availability of products or services is not guaranteed until confirmed in writing. If a product is unavailable, we will notify you promptly and issue a full refund where applicable.
2. Prices and Payment
Prices are displayed in [EUR] and are inclusive of VAT, where applicable. Payment must be made in full prior to the delivery of goods or services.
We accept the following payment methods:
- Bank Transfer
- PayPal
- Credit/Debit Card (via Stripe or equivalent processor)
You confirm that the payment method used belongs to you and that you are authorized to use it.
If your account is not denominated in EUR, your bank or card provider may charge additional fees or apply an exchange rate. We are not responsible for these costs.
In addition to the product/service cost, an administrative and handling fee of 2.5% (for clients in the EU) or 10% (Rest of World) may be applied to cover taxes, duties, payment fees, and logistics.
3. Delivery and Fulfillment
We aim to fulfill all orders within the agreed timeframe. However, delays may occur due to unforeseen circumstances. We shall not be liable for any delay caused by events outside our reasonable control.
Shipping is carried out using tracked or insured methods when applicable. Delivery costs and estimated times will be detailed in your confirmation.
You are responsible for any customs duties or import taxes required by your country. Please check with your local authorities prior to ordering.
4. Returns and Refunds
Returns or cancellations are only accepted under the conditions outlined in our Returns Policy, which will be provided upon request or alongside your order confirmation.
Custom-made or digital products (e.g., music productions, designs, downloadable files) are non-refundable once work has begun or the product has been delivered.
This policy does not affect your statutory rights under applicable EU consumer protection laws.
5. Liability
We are only liable for damages arising from gross negligence or willful misconduct. Our liability is limited to the total amount paid for the product or service in question.
We are not liable for any indirect or consequential damages (including loss of data, profit, or business) unless explicitly stated in applicable consumer laws.
6. Intellectual Property
All content (music, images, designs, texts) on this site and in our services is the property of Nati Davis unless otherwise credited. No part may be copied, reused, or distributed without prior written consent.
If you request a custom product using third-party content (e.g., samples, logos, lyrics), you affirm that you own the rights or have permission to use such content. You shall indemnify us against any legal claims arising from copyright violations or misuse.
7. Written Communications
By engaging with our website or services, you agree that communications (invoices, order confirmations, etc.) may be sent electronically and will satisfy any legal requirement for written communication.
8. Severability
If any provision of these Terms is deemed invalid or unenforceable, the remainder of the Terms shall remain in effect.
9. Governing Law and Jurisdiction
These Terms shall be governed by the laws of Germany. Any dispute arising from or related to these Terms or the use of our services shall be subject to the exclusive jurisdiction of the courts in Germany.
10. Entire Agreement
These Terms, along with any referenced policies or order confirmations, represent the entire agreement between you and Nati Davis – Musikproduktionen, Designs.
